Terms and conditions for BoMark

By using our website and services, you agree to comply with and be bound by the following terms. Please review them carefully.

1. Description of Service
BoMark provides digital watermarking solutions for e-books and PDF documents. Our service embeds unique identifiers—either visible or invisible—to help content creators track and protect their intellectual property.

2. Ownership of Content
Your Content: You retain full ownership and copyright of any files uploaded to our service. BoMark does not claim any rights to your intellectual property.

Our Service: We own the technology, software, and branding associated with BoMark. You are granted a limited, non-exclusive license to use the service for its intended purpose.

3. User Responsibilities & Warranties
By uploading a file, you represent and warrant that:

  • You are the legal owner of the content or have express permission from the copyright holder to watermark the file.
  • The content does not violate any third-party rights, including privacy or intellectual property rights.
  • The content is not illegal, defamatory, or harmful.

4. Data Retention and Privacy
To process your files, we must store them on our servers. AWS S3 is used to store source files securely and transferred to a web server to watermark and personalise a file

Personal Data: We collect only the data necessary to provide the service (e.g., name and email address for watermarking and sending mails). We do not sell your personal information to third parties.

Metadata: You acknowledge that the watermarking process involves modifying the file’s metadata or structure to include tracking information.

5. Limitation of Liability
While our watermarking technology is designed to discourage piracy, BoMark does not guarantee that:

  • Watermarks cannot be removed by sophisticated third parties.
  • The presence of a watermark will prevent unauthorized distribution.
  • Our service will be 100% error-free or uninterrupted.
  • No Liability: BoMark shall not be held liable for any loss of data, loss of revenue, or copyright infringement occurring after a file has been processed and downloaded.

6. You need an active subscription to use BoMark and watermark files. Any credits remaining at the end of a subscription period can be carried over to the next subscription period within one year. If a subscription has expired for more than a year, the account will be deleted along with all files and transactions. 

7. Payments and Refunds
Fees: Prices for subscription and watermarking credits are displayed at the Prices page.

Refunds: Due to the digital nature of the service, refunds are generally not provided once a file has been successfully processed, except in cases of technical failure on our end.

8. Prohibited Use
You may not use BoMark to:

  • Watermark pirated or illegally obtained material.
  • Attempt to reverse-engineer our watermarking algorithms.
  • Automate the service via bots or scripts without prior written consent.

9. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the service after changes are posted constitutes your acceptance of the new terms.
